Major Portion Prices and Due Date for Additional Royalty Payments on Indian Gas Production in Designated Areas Not Associated With an Index Zone

SUMMARY: Final regulations for valuing gas produced from Indian leases, published on August 10, 1999, require MMS to determine major portion prices and notify industry by publishing the prices in the Federal Register. The regulations also require MMS to publish a due date for industry to pay additional royalty based on the major portion prices. This notice provides the major portion prices for the 12 months of 2005. The due date to pay additional royalties based on the major portion prices is 60 days after the publication date of this notice.

This notice is given so that the Service may continue to fulfill its obligations under NAGPRA by distributing its findings for review by all interested parties. Copies of this report have already been provided to the requesting Tribes.

Notice of Availability of Draft Environmental Impact Statement for the Proposed Transfer From Fee-to-Trust Land of Oneida Indian Nation of New York

This notice advises the public that the Bureau of Indian Affairs (BIA) will be holding an additional public hearing to receive comments on its Draft Environmental Impact Statement (DEIS) for the proposed fee-to-trust transfer of Oneida Indian Nation of New York land in Oneida and Madison Counties, New York. This notice also reminds the public that the public comment period for the DEIS has been extended to February 22, 2007, as announced in the Federal Register on January 5, 2007, by the Environmental Protection Agency (EPA), and in local media by the BIA. The EPA's original notice of availability for the DEIS and the BIA's supplement to the EPA notice, both of which were published in the Federal Register on November 24, 2006, announced a closing date for comments of January 8, 2007.

Pokagon Band of Potawatomi Indians of Michigan Liquor Control Ordinance

SUMMARY: This notice publishes the Liquor Control Ordinance of the Pokagon Band of Potawatomi Indians of Michigan (Tribe). The Ordinance regulates and controls the possession, sale and consumption of liquor within the Pokagon Band of Potawatomi Indians Reservation. This reservation is described as ``all lands, the title to which is held in trust by the United States for the benefit of the Pokagon Band of Potawatomi Indians; and * * * all lands * * * part of the Tribe's reservation.'' This ordinance, however, applies only to the Tribe's reservation lands within the State of Michigan. This Ordinance allows for possession and sale of alcoholic beverages within the Pokagon Band of Potawatomi Indians Reservation, and increases the ability of the tribal government to control the Tribe's liquor distribution and possession. At the same time it will provide an important source of revenue for the continued operation and strengthening of the tribal government and the delivery of tribal services.

Pueblo of Pojoaque Liquor Control Act

SUMMARY: This notice publishes the Pueblo of Pojoaque Liquor Control Act. The Act regulates and controls the possession, sale and consumption of liquor within the Pueblo of Pojoaque Indian Reservation. The reservation is located on trust land and this Act allows for the possession and sale of alcoholic beverages within the exterior boundaries of the Pueblo of Pojoaque Indian Reservation. This Act will increase the ability of the tribal government to control the distribution and possession of liquor within their reservation, and at the same time will provide an important source of revenue and strengthening of the tribal government and the delivery of tribal services.

Indian Trust Management Reform

SUMMARY: On August 8, 2006, the Bureau of Indian Affairs (BIA) and the Office of the Secretary proposed to amend several of their regulations related to Indian trust management (see 71 FR 45173). The rule proposes to address Indian trust management issues in the areas of probate, probate hearings and appeals, tribal probate codes, life estates and future interests in Indian land, the Indian land title of record, and conveyances of trust or restricted land. The proposed rule also includes an ``Application for Consolidation by Sale'' form that is associated with one of these amendments. On November 1, 2006, the BIA and the Office of the Secretary reopened the comment period for an additional 60 days to January 2, 2007 (see 71 FR 64181). This notice reopens the comment period an additional 45 days to March 12, 2007. The BIA and Office of Secretary again are extending the comment period by 45 days to ensure that all interested parties, including tribes and individual Indians, have the opportunity to review the proposed rule and prepare their comments.

Native American Graves Protection and Repatriation Review Committee Findings and Recommendations Regarding Cultural Items in the Possession of the Field Museum

SUMMARY: At a November 3-4, 2006, public meeting in Denver, CO, the Native American Graves Protection and Repatriation Review Committee (Review Committee) considered a dispute between the White Mountain Apache Tribe and the Field Museum. The dispute focused on whether 33 items (catalogue records) in the possession or control of the Field Museum are ``objects of cultural patrimony'' and whether the Field Museum has a ``right of possession'' to them under provisions of the Native American Graves Protection and Repatriation Act (NAGPRA) [25 U.S.C. 3001 et seq.]. The Review Committee finds that, by a preponderance of the evidence, these items are ``objects of cultural patrimony'' and that the Field Museum does not have a ``right of possession'' to them.

SUMMARY: Notice is hereby given, pursuant to 25 CFR 514.1(a)(3), that the National Indian Gaming Commission has adopted preliminary annual fee rates of 0.00% for tier 1 and 0.059% (.00059) for tier 2 for calendar year 2007. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self-regulation under 25 CFR part 518, the preliminary fee rate on class II revenues for calendar year 2007 shall be one-half of the annual fee rate, which is 0.0295% (.000295).

SUMMARY: To comply with the Paperwork Reduction Act of 1995 (PRA), we are inviting comments on a collection of information that we will submit to the Office of Management and Budget (OMB) for review and approval. The title of this information collection request (ICR) is ``30 CFR Part 206--Product Valuation, Subparts F and J; Part 210--Forms and Reports, Subparts E and H; and Part 218--Collection of Royalties, Rentals, Bonuses and Other Monies Due the Federal Government, Subpart E.'' We changed the title of this ICR to clarify the regulatory language we are covering under 30 CFR parts 206, 210, and 218 and to reflect OMB consolidation approval of two solid mineral-related ICRs.

The Three Affiliated Tribes of the Fort Berthold Indian Reservation Amendment to Their Liquor Ordinance

SUMMARY: This notice publishes an amendment to the Liquor Ordinance of the Three Affiliated Tribes of the Fort Berthold Indian Reservation of North Dakota (Tribe). SUMMARY: This notice publishes the Buena Vista Rancheria of Me-Wuk Indians Liquor Control Ordinance. The Ordinance regulates and controls the possession, sale and consumption of liquor within the Buena Vista Rancheria of Me-Wuk Indian's tribal land. The tribal land is located on trust land and this Ordinance allows for the possession and sale of alcoholic beverages within the exterior boundaries. This Ordinance will increase the ability of the tribal government to control the distribution and possession of liquor within their tribal land strengthen the tribal government. At the same time, it will provide an important source of revenue and the improve delivery of tribal services.

Migratory Bird Subsistence Harvest in Alaska; Harvest Regulations for Migratory Birds in Alaska During the 2007 Season; Final Rule

SUMMARY: The U.S. Fish and Wildlife Service (Service or we) is publishing harvest regulations for migratory bird subsistence hunting in Alaska for the 2007 season. This final rule establishes regulations that prescribe frameworks, or outer limits, for dates when harvesting of birds may occur, species that can be taken, and methods and means that are excluded from use. These regulations were developed under a Co-management process involving the Service, the Alaska Department of Fish and Game, and Alaska Native representatives. These regulations provide a framework to enable the continuation of customary and traditional subsistence uses of migratory birds in Alaska.

Migratory Bird Hunting: Alaska; 2007-08 Spring/Summer Subsistence Harvest Regulations; Indian Tribal Proposals and Requests; Proposed Rule

SUMMARY: The U.S. Fish and Wildlife Service (hereinafter the Service or we) proposes to establish annual hunting regulations for certain migratory game birds for the 2007-08 hunting season. We annually prescribe outside limits (frameworks) within which States may select hunting seasons. This proposed rule provides the regulatory schedule, describes the proposed regulatory alternatives for the 2007-08 duck hunting seasons, requests proposals from Indian tribes that wish to establish special migratory game bird hunting regulations on Federal Indian reservations and ceded lands, and requests proposals for the 2008 spring/summer migratory bird subsistence season in Alaska. Migratory game bird hunting seasons provide hunting opportunities for recreation and sustenance; aid Federal, State, and tribal governments in the management of migratory game birds; and permit harvests at levels compatible with migratory game bird population status and habitat conditions.

Notice of Establishment of the Sand Creek Massacre National Historic Site

SUMMARY: Under Public Law 106-465, the Sand Creek Massacre Site Establishment Act of 2000, the Secretary of the Interior hereby announces that sufficient lands have been acquired to establish the Sand Creek Massacre National Historic Site in Kiowa County, Colorado. Public Law 106-465 called for the Secretary of the Interior to establish the Sand Creek Massacre National Historic Site once the Secretary had determined that sufficient lands had been acquired by the federal government to provide for the preservation, memorialization, commemoration, and interpretation of the Sand Creek Massacre. The Act authorized the National Park Service to acquire up to 12,500 acres from willing sellers for this purpose.

SUMMARY: The National Indian Gaming Commission (NIGC) today is publishing an agenda of its open and anticipated rulemaking actions. The agenda is a general announcement to the public intended to provide notice of rulemaking actions in which the public may wish to participate. In the future, the NIGC intends to issue notices of proposed rulemaking, advance notices of proposed rulemaking, or final rules for the following: rules establishing classification standards for gaming machines; rules establishing technical standards for gaming machines and associated equipment; rules revising the audit standards that apply to Indian gaming facilities; rules revising Privacy Act procedures; rules establishing a process for the assessment, notification, and collection of debts owed the NIGC; rules revising tribal background investigation submission requirements and timing; rules concerning hearings and appeals procedures; rules revising the scope and review of management contracts; rules concerning the definitions of ``electronic or electromechanical facsimile,'' ``net gaming revenue,'' ``sole proprietary interest,'' and ``key employee''; rules concerning gaming facility licensing standards; rules concerning administrative fees; rules revising and updating the civil fines provisions; rules concerning technical amendments to the NIGC's Minimum Internal Control Standards (MICS); and rules concerning background investigations and licenses for key employees and primary management officials. The NIGC invites questions and public comment on individual agenda items.
