The National Indian Gaming Commission will ask federal marshals to shut down the casino owned by the Coyote Valley Band of Pomo Indians of California.
Last week, NIGC chairman Phil Hogen issued a Notice of Violation to the tribe. The notice stated that the tribe was operating Class III games without a valid tribal-state compact.
The tribe plans to appeal the order but said in a letter to employees that the casino will remain open. The tribe had been challenging the compact process but lost a decision in the 9th Circuit Court of Appeals. The U.S. Supreme Court declined to review the case.
