Delaware Tribe wants out-of-state land for casino

The Delaware Tribe of Oklahoma has filed a land-into-trust application for 80 acres in Bonner Springs, Kansas.

The tribe intends to open a casino on the property. Normally, gaming is barred on trust land acquired after 1998 but the tribe is claiming an exception.

The exception allows gaming on a tribe's "last" reservation. The Delaware Tribe, currently landless, says its last reservation was in the Kansas City area.

The Wyandotte Nation of Oklahoma made a "last" reservation argument for its casino in downtown Kansas City but was rejected by the National Indian Gaming Commission.
