NIGC publishes latest final revisions to MICS


The National Indian Gaming Commission published final revisions to the Minimum Internal Control Standards in the Federal Register on Thursday.

The MICS cover nearly every aspect of the day-to-day regulation of Class III gaming. Tribes are required to meet or exceed the MICS, according to the NIGC.

The legality of the MICS is in doubt. An administrative law judge and a federal judge have ruled that the agency's lacks authority to regulate Class III gaming under the Indian Gaming Regulatory Act.

According to the notice published yesterday, the judge's decision does not bar the NIGC from enforcing the MICS on all tribes, just the tribe involved in the case. The decision is being appealed by the Bush administration.
