Department of Justice to appeal Wyandotte ruling

The Department of Justice is appealing a ruling that paved the way for the Wyandotte Nation of Oklahoma to reopen its casino in downtown Kansas City, Kansas.

The National Indian Gaming Commission had said the site didn't qualify for gaming. But U.S. District Judge Julie Robinson in June ruled that the reasoning behind the NIGC's decision was flawed.

The tribe opened a Class II facility on the trust parcel. It was raided by the state of Kansas, who was later ordered to return the tribe's equipment and cash.
