California's gaming compacts upheld in court


The California Court of Appeals rejected a challenge to the tribal-state gaming compact.

California Commerce Casino, a non-Indian card club, sued state officials for entering into the agreement in 2004. The card club claimed the compacts violated the state constitution.

But the court said the lawsuit was filed too late. It should have come within 60 days of approval of the state law that authorized the compacts, the court said.

Separately, the federal courts have upheld the validity of the gaming compact.
