Pojoaque Pueblo in dispute with former worker


Pojoaque Pueblo in New Mexico is trying to prevent a former casino employee from collecting damages for alleged retaliation.

The tribe fired David Martinez and revoked his gaming license in January. The tribe's gaming commission said he had been making "false and misleading statements" about an earlier work-related injury.

The tribe previously paid $4,427 to Martinez for his foot injury. Martinez is now trying to re-open the claim to seek damages for alleged retaliation.

Under its gaming compact with the state, the tribe waived its sovereign immunity for workers’ compensation claims. But the tribe says the waiver doesn't apply to other matters like retaliation.
