The Seneca Nation of New York filed a friend of the court brief on Monday in hopes of keeping its off-reservation casino open.
The tribe operates the Buffalo
Creek Casino in a temporary facility in downtown Buffalo. Opponents want the casino shut down because a federal judge ruled that the site does not qualify for gaming under the Indian
Gaming Regulatory Act of 1988.
The Department of Justice is appealing the decision. The tribe is not a party to the case but included statements of support from Buffalo Mayor Byron W. Brown and Erie County Executive Chris Collins in its brief.
"To prohibit gaming on the nine acres that has been decreed Indian land would deprive Buffalo of a new source of much-needed revenue for future economic development projects," Brown said in his declaration, according to news reports.
