Briefs submitted to 10th Circuit in Kialegee gaming dispute

Opening briefs have been submitted to the 10th Circuit Court of Appeals in the Kialegee Tribal Town casino case.

The tribe announced plans for the Red Clay Casino on an Indian allotment near Tulsa. Judge Gregory Frizzell blocked the project and ruled that the tribe lacked jurisdiction at the site, a key requirement of the Indian Gaming Regulatory Act.

Frizzell also said the casino would violate the tribe's Class III gaming compact. He further ruled that tribal officials were not protected by sovereign immunity.
