Judge delays fee issue in Tohono O'odham Nation casino suit

A federal judge won't rule on $4.2 million in attorney fees requested by the Tohono O'odham Nation of Arizona for wining a gaming lawsuit.

Judge David Campbell said it was too early to consider the tribe's request, the Associated Press reported. He noted that an appeal is pending after he ruled that the Class III gaming compact does not bar an off-reservation casino in the metro Phoenix area.

The tribe plans to open the West Valley Resort but faces opposition from the state and tribes with existing casinos in the Phoenix area. H.R.1410, a bill to block gaming on newly acquired trust land, is being considered by the House Natural Resources Committee at a markup session this morning.
