Supreme Court takes up Bay Mills gaming case on December 2

The U.S. Supreme Court will hear Michigan v. Bay Mills Indian Community, an Indian gaming case, on December 2.

The court will determine whether the Bay Mills Indian Community can be sued by the state of Michigan for operating an off-reservation casino. The facility, which has remain closed since March 2011, is located on land that hasn't been placed in trust.

Tribes in Michigan and across the nation are worried that a negative outcome will affect their sovereign immunity. They have called on the National Indian Gaming Commission to take action in a way that could end the dispute but so far the Obama administration hasn't intervened.
