Supreme Court due to hear tribal casino case from Michigan



Tribal gaming issues in Michigan will once again be before the U.S. Supreme Court in the coming year.

Last year, the court issued its ruling in Salazar v. Patchak, a case involving the Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians, also known as the Gun Lake Tribe. The ruling held that the tribe's land-into-trust application can be litigated even after opening a casino.

The court will now be considering a dispute involving the Bay Mills Indian Community. The tribe opened an off-reservation casino without first going through the land-into-trust process.

A federal judge ordered the facility to be closed and it's stayed that way even though the 6th Circuit Court of Appeals lifted the injunction last August. The decision determined that tribe can't be sued under the Class III gaming compact or the Indian Gaming Regulatory Act.

Those issues will now be before the justices in Michigan v. Bay Mills Indian Community. Oral arguments will take place during the Supreme Court's next term, which begins in October.

The outcome will most likely affect the Sault Ste. Marie Tribe of Chippewa Indians, also in Michigan. A federal judge held that the tribe can be sued and barred the tribe from starting the land-into-trust process for an off-reservation casino. The tribe is appealing to the 6th Circuit.
