The Tohono O'odham Nation and the state of Arizona continue to spar over the legality of the tribe's new gaming facility.

The tribe opened the Desert Diamond West Valley Casino and Resort in Glendale last December after overcoming numerous legal and political hurdles. But a big one remains -- whether Class III games can be offered at the site.

The Arizona Department of Gaming won't certify the facility for Class III games because the state contends the tribe pursued the casino through fraudulent means. A similar claim was considered in a different lawsuit that the tribe won but the state hopes to gather additional evidence as part of the new case, Capitol Media Services reported.

The tribe is opposing the request, saying the state already claims to have all the information it needs about the casino.
