Judge issues another ruling in favor of Oneida Nation
Monday, October 31, 2005

A federal judge issued a second ruling on Friday in favor of the Oneida Nation, halting Oneida County from foreclosing on the tribe's properties.

U.S. District Court Judge David Hurd blocked Oneida County from seizing the tribe's land over unpaid taxes. The tribe owes over $956,000 on 62 parcels, The Syracuse Post-Standard reported.

Hurd has already blocked Madison County from foreclosing on 98 parcels. The tribe owes more $3 million, the county says.

The tribe is subject to local taxes on land that hasn't been taken into trust. But Hurd said the recent U.S. Supreme Court decision in the Sherrill case hasn't eliminated the tribe's immunity as a sovereign.
