Sacred site case could land before Supreme Court

The Department of Justice is considering an appeal of a sacred site case in Arizona.

In March, the 9th Circuit Court of Appeals ruled that the U.S. Forest Service violated the religious rights of several tribes by approving the expansion of a ski area in the Coconino National Forest. The expansion would allow the use of reclaimed wastewater to make snow in the sacred San Francisco Peaks.

Government attorneys recently asked for an extension as they consider an appeal to the U.S. Supreme Court. DOJ could also ask for a rehearing before the 9th Circuit.
