Cobell to appeal $455.6M ruling 'as soon as possible'
Elouise Cobell, the lead plaintiff in the Indian trust fund lawsuit, said an appeal of a $455.6 million restitution judgment will be filed "as soon as possible" during an appearance on Democracy Now.

"The opinion is both profoundly disappointing and difficult to understand, in that it disregards unchallenged evidence of the record, law of the case, law of the D.C. Circuit since 1895, and settled law as set forth by the United States Supreme Court," Cobell said on the program.

Judge James Robertson ruled that the Cobell plaintiffs failed to prove they were owed a much larger sum for the federal government's failure to account for billions of dollars of Indian trust funds. He also rejected claims that the government benefited from the failure to distribute all of the funds.
