Prosecutors seek alibis in Aquash murder case

The
U.S. Attorney's Office
in South Dakota wants the two men accused of murdering American Indian Movement activist

Aquash to give their alibis for the December 12, 1975, crime.
Prosecutors accuse John Graham, a Native man from Canada, of shooting Aquash in the head. They say Richard Marshall supplied the gun used to kill Aquash.
The crime took place on the Pine Ridge Reservation in South Dakota. Graham, who is not a member of a U.S.-recognized tribe, says the federal courts lack jurisdiction because he is not an "Indian" as defined by federal law.
Marshall is a member of the
Oglala Sioux
Tribe. Arlo Looking Cloud, who was convicted of his role in the murder, is also Oglala Sioux.
Aquash was Mik'maq from Canada. She was not a member of a U.S.-recognized tribe.
