Supreme Court won't hear Blackfeet housing case
The U.S. Supreme Court on Monday rejected a petition in Marceau v. Blackfeet Housing Authority.

The case affects homes that were built by the Blackfeet Nation of Montana using federal funds. Tribal members said the homes became infested with mold, causing a host of health problems.

The 9th Circuit Court of Appeals heard the case three times. The most recent opinion said the plaintiffs must exhaust their remedies in tribal court before heading to federal court.

The court also said Department of Housing and Urban Development did not have a trust duty to ensure the safety of the homes.

Tribes were worried about the case because it could have affected their sovereign immunity. The 9th Circuit, however, said it made an "error" by addressing the issue.
