A leader of Pojoaque Pueblo in New Mexico "partied" with a group of friends before she allegedly stuck and killed a pedestrian, according to court documents that were reviewed by The Santa Fe New Mexican.

Lt. Governor Linda Diaz, 52, had at least one beer, and as many as three, a friend told a Bureau of Indian Affairs investigator. But she "did not seem intoxicated," the friend said.

Diaz drove the group around in her car before she allegedly struck Phillip Espinoza, 31, along a highway on the Pojoaque Reservation in the early morning hours of April 4. She didn't report the incident to tribal police until a day later.

Diaz has been indicted in federal court on charges of leaving the scene of a fatal accident and failing to render aid.
