The House passed a bill last week requires tribes to participate in a national criminal registry for arsonists and bombers.

H.R.1727, the Managing Arson Through Criminal History Act, allows tribes to submit information about arsonists and bombers directly to the Department of Justice. But those tribes that choose not to send information must enter into a cooperative agreement with a state government.

"It does not say what happens when a tribe refuses to implement the bill, refuses to enter into a cooperative agreement, or opts in but fails to implement it," the Turtle Talk blog noted in a posting today.

The provision is similar to one in the Adam Walsh Child Protection and Safety Act that required tribes to participate in a national sex offender registry or cede that function to state government.
