Lawsuit questions constitutionality of Indian Child Welfare Act

A new lawsuit challenges the constitutionality of the Indian Child Welfare Act. The plaintiffs include Christy Maldonado, the non-Indian woman who put Veronica Brown, a citizen of the Cherokee Nation, up for adoption. They say certain provisions of the law that aim to keep Indian children in Indian homes are based on race and should be thrown out. The main defendant is the Department of Justice. But the Cherokee Nation is also named, presumably due to Maldonado's involvement. The lawsuit was filed in federal court in South Carolina.
