Cherokee Nation father files second appeal in adoption dispute

Cherokee Nation citizen Dusten Brown filed a second appeal with the Oklahoma Supreme Court after he was again ordered to turn his daughter over to a non-Indian couple.

Brown is already appealing an order from Nowata County court to transfer his daughter to the couple. The state Supreme Court has put a temporary hold on the decision.

Brown filed a new appeal in response to a decision from the Muskogee County court. The judge in that case told The Muskogee Phoenix that the adoption dispute belongs in South Carolina, where the non-Indian couple lives.

Brown is disputing the validity of the adoption proceedings. His daughter is living with her Cherokee family on tribal trust land.

The Cherokee Nation courts also have asserted jurisdiction.
