Hearing scheduled in Mishewal Wappo Tribe's recognition case

After failing to reach a settlement with the Obama administration, the Mishewal Wappo Tribe of California is headed back to court with its federal recognition lawsuit.

The tribe was listed for termination in an act of Congress but the lawsuit accuses of the Bureau of Indian Affairs of failing to comply with the law. The tribe says it has been trying to restore its status since 1961, when a notice was printed in the Federal Register.

The Department of Justice argues that the tribe should have sued within six years of the 1961 notice. A hearing on motions for summary judgement takes place July 25, The Napa Valley Register reported.
