Charges filed over assault and battery of transgender Native man

A Massachusetts man has been charged in connection with an attack on a member of the Mashpee Wampanoag Tribe.

Patrick Horan, 21, is being accused of one count of assault and battery and one civil rights violation, The Worcester Telegram reported. He allegedly spit on Jameson N. Fernandez, 30, and made disparaging remarks about Fernandez's gender orientation in an incident that occurred on Memorial Day, May 30.

"I wish he had punched me. That’s what you do to a man. To spit, that’s lower than anything I could imagine," Fernandez told the paper. He also posted a video on Facebook about his experience.

The incident arose after Fernandez called AAA when his car broke down. Horan, who was working for a towing company dispatched by AAA, refused to assist Fernandez.

"The driver is no longer employed at my families company," Jeffrey Cranston of W.C. Cranston & Son wrote on Facebook after learning about Fernandez's treatment. "I acted swiftly to apologize to the AAA member."

Fernandez otherwise said his gender transition has been embraced by those with whom he comes into contact. He legally changed his name in January, The Telegram reported.
