U.S. District Judge Royce C. Lamberth held the Environmental Protection Agency in contempt on Thursday for destroying records against court orders.

In response to a Freedom of Information Act lawsuit, Lamberth ordered EPA to retain all potential documents at the very end of the Clinton administration. But former EPA chief Carol M. Browner and her former aides deleted e-mails and other information from computers.

Lamberth ordered EPA to pay fines to a company that sought the documents but declined to sanction Browner and the aides. In making his decision, Lamberth cited the D.C. Circuit Court of Appeals' July 18 ruling vacating contempt charges against Secretary of Interior Gale Norton and former aide Neal McCaleb for their handling of the Indian trust.
