N.Y. tribes opposing state plan to collect tax

Tribes in New York are planning to fight an attempt by the state to collect taxes on the sale of gas and cigarettes.

The Supreme Court has ruled that sales to non-Indians can be taxed by the state. But the New York courts have said collection is not mandatory.

Gov. George Pataki (R) is now proposing to collect the taxes. The Department of Taxation and Finance on Friday proposed regulations that would go into effect December 1.
