Appeals court pick goes to Senate

The Senate Judiciary Committee on Thursday approved the nomination of President Bush's pick to the 3rd Circuit Court of Appeals.

The vote was 12 to 7 with three Democrats joining all Republicans to support D. Brooks Smith. Smith was opposed by feminist, environmental and civil rights groups.

Smith is currently a federal judge in Pennsylvania. He goes to the full Senate for a final vote.
