A parcel of land where a Navajo man was found beaten to death is not Indian Country, a New Mexico appeals court has ruled.

In a unanimous opinion, the court on Friday the area is under state jurisdiction. The ruling gives the green light for state prosecution of Robert Ray Fry.

Fry is accused of murdering Donald Tsosie in 1998. A co-defendant has pleaded guilty.

The land in question is 1,400 feet from the Navajo Reservation, according to The Farmington Daily-Times. The Bureau of Land Management supervises the area.
