Activist loses bid to get journals back

An American Indian activist who is serving a life sentence for murder can't get his journals back from his old attorney, a North Carolina judge ruled.

Eddie Hatcher said he loaned his journals to lawyer Barry Nakell. But Nakell claims they were a gift.

Hatcher in May 2001 was convicted of first-degree murder and shooting into an occupied building. He also served time for 1998 incident in which he held members of a newspaper staff hostage.

Nakell currently represents Rebekah Revels, the Lumbee woman who was denied a chance to compete in the Miss America pageant after an ex-boyfriend said he had revealing photos of her. In that case, she is suing the pageant and wants to sue the state beauty contest.
