The state of New Mexico and Pojoaque Pueblo continue to battle over the tribe's water usage.

The state is asking a federal judge to limit the tribe's current and future usage. The tribe counters that the state hasn't shown how it will be harmed.

A federal magistrate has recommended that the state's request for a preliminary injunction be denied.

The tribe's water rights are the subject of a long-running case.
