Supreme Court allows veterans' Agent Orange suit

The Supreme Court on Monday let stand a ruling that allows Vietnam veterans a chance to pursue claims against companies who manufactured the herbicide Agent Orange.

The court was unable to arrive at a decision because it was deadlocked 4-4 on the case. Justice John Paul Stevens recused himself, resulting in the unusual outcome.

The core issue was whether veterans should be allowed to litigate claims after a $160 million settlement was reached with the chemical companies. The money was already paid out by the time the veterans discovered illnesses they attribute to Agent Orange, used during the Vietnam War by the U.S.
