North Dakota Attorney General Wayne Stenehje won't investigate phone calls made by members of Board of Higher Education prior to their decision to keep the "Fighting Sioux" nickname of the University of North Dakota.

Stenehje said the 30-day statute of limitations to investigate if the December 20 phone calls violated the state's "open meeting" laws has expired. Five UND profesors had asked Stenehje to investigate but since they found out about the phone calls nearly a month after they occurred, they wanted the statute of limitations to start on January 15.

Stenehje said the law is clear on the matter, however, and said he can't follow up. But he said civil charges could force the board to reconsider its vote.
