TUESDAY, OCTOBER 2, 2001 The Supreme Court on Monday rejected the state of Nebraska's appeal to wiggle out of a low-level nuclear waste disposal facility. In 1983, Nebraska signed a multi-state compact to store the waste. But when a site in the state was actually chosen, officials said they would not allow facilities to be built for it. The withdrawal led to a lawsuit in which the state tried to assert sovereign immunity. The 8th Circuit Court of Appeals in March rejected the defense. With the Supreme Court declining to hear the case, the compact commission can now move forward with seeking damages from the state. Get the Story:
