MONDAY, OCTOBER 29, 2001

The New Mexico Supreme Court last Thursday rejected Pojoaque Pueblo's attempt to shut down a mica mine on sacred land.

The tribe was against a 20-year, 80-acre expansion of the mine. But the legal challenge was filed too late, state courts have said.

Gov. Gerald Nailor said the fight wasn't over, however, and promised to file a suit if mine operators Oglebay Norton violate the conditions of its state permit. Meanwhile, a protest is planned on November 9.

Picuris is located in northern New Mexico.
