State opposes treaty lawsuit

Washington Governor Gary Locke and Attorney General Christine Gregoire on Tuesday criticized a lawsuit filed by 20 tribes seeking protection of their treaty rights, saying it will be "expensive and time consuming."

The tribes have filed suit against the state, seeking the repair of culverts in order to protect threatened and endangered runs of salmon. The tribes want the culverts identified and repaired on a quicker time scale than that proposed by the state.

The lawsuit is being called the "Boldt II" lawsuit, in reference to the landmark 1970s case which acknowledged the fishing rights of tribes in the state.
