APRIL 24, 2001

Members of the Standing Rock Sioux Tribe who sued the Army Corps of Engineers for failing to protect the graves of their ancestors on Monday filed to dismiss their case from federal court.

After months of negotiation, the two parties have reached an agreement on the graves. The tribal members were seeking protection of the graves, which had been exposed due to dropping water levels in Lake Oahe.

The remains were supposed to have been moved by the Army Corps in 1960. That apparently never happened.

As part of its settlement, the Army Corps will riprap the Missouri River shoreline in northern South Dakota to stop erosion. The Army Corps will also determine if it did its job properly in 1960.
