The 10th Circuit Court of Appeals on Wednesday upheld the Environmental Protection Agency's decision to allow the state of Montana to pass weakened water quality laws.

The court ruled the EPA has no authority under the Clean Water Act to regulat non-point source discharges. Environmental groups had sued the EPA after the agency approved the state's laws.
