The Missisquoi Abenaki Tribe of Vermont is asking the state to stop construction of homes in Highgate for fear of disturbing a burial ground.

The state in the past has purchased land to protect Abenaki burials. But a state commissioner said the state doesn't have the authority to order a moratorium on locally issued permits.

Intentional removal or excavation of remains in Vermont is a felony punishable by up to 15 years in prison and a $10,000 fine. Abenaki remains have been found at various sites and the state has purchased those lands in order to protect them.
