Cherokee-Delaware case up for dismissal

A lawsuit filed by the Cherokee Nation of Oklahoma against the Delaware Tribe might be dismissed if Delaware lawyers have their way.

The Delaware Tribe was once part of the Cherokee Nation. But in 1996, the tribe was recognized as a separate entity by the Department of Interior.

The Cherokee Nation filed suit in response, seeking to protect their sovereign rights. Now, a federal judge is giving lawyers for both sides until February 15 to argue for a dismissal.

The Loyal Shawnee were also separated from the Cherokee Nation by Congress last year. But the Cherokee Nation supported the separate recognition, provided it could approve certain actions by the Shawnee.
