The Supreme Court on Monday agreed to hear a case affecting affirmative action programs instituted by the federal government.

The case involves a highway construction program that offers incentives to companies to use minority owned firms. The program is being challenged by two companies, one of whom previusly challenged it in 1990.

That case, brought by a white-owned firm in Colorado, resulted in a Supreme Court decision which didn't prohibit affirmative action programs but said they had to satisy a strict set of circumstances. The Court will clarify whether the revised program meets them.

The 10th Circuit Court of Appeals said it did but some say the Supreme Court will reverse the decision.
