Having been allowed to intervene in the case, the state of Illinois on Friday asked a federal judge to dismiss the Miami Nation of Oklahoma's claim for 2.6 million acres promised in an 1805 treaty.

The state says the tribe's claim is without merit and has already been rejected by the Indian Claims Commission. A lawyer for the tribe denied the particular land in question was the subject of an earlier claim.
