Scott Podhradsky, Charles Mix County Attorney, defended charging a police officer with a misdemeanor instead of a more serious charge for allegedly choking a 12-year-old Indian boy.

Activists marched on the Yankton Sioux Reservation in Lake Andes last week, demanding that the officer be fired for the incident. Podhradsky said the incident was not racially motivated and said officer Michael Atwood "just lost his cool."

As of last week, the tribe, the Bureau of Indian Affairs, and the South Dakota Division of Criminal Investigation were also conducting investigations.

Ever since a Supreme Court decision gave jurisdiction back to local law enforcement over Charles Mix County, many Indian residents have complained of racial targeting, profiling, and bias, charges police and state Governor Bill Janklow deny.
