Mont. tribal court lawsuit thrown out

TUESDAY, SEPTEMBER 11, 2001 The 9th Circuit Court of Appeals last week ruled that a Crow tribal member cannot sue a non-Indian in tribal court for an automobile accident. Even though a consensual relationship may have existed between Heather Long Warrior and Michael Boxx, the relationship must be of a commercial nature in order for a tribal court to have authority, the 9th Circuit said. Warrior had sued Boxx for damages but the tribal court said it lacked jurisdiction. She then made appeals to the tribal appellate court while Boxx challenged her case in federal court. Get the Case:
