The attorneys for the man who is set to become New Mexico's first execution in 41 years on Thursday said they would ask the State Supreme Court to save Terry Clark's life.

State District Judge David Bonem has refused to halt the execution, which is scheduled to occur next week. Clark, convicted of kidnapping, raping and killing a 9-year-old girl, says he is ready to die and doesn't want his case appealed any more.
