Appeal saves Napster from shutdown

The Ninth Circuit Court of Appeals in San Francisco this afternoon has ruled that the Napster music service can stay open while the company prepares a formal appeal to an injunction issued earlier this week by US District Court Judge Marilyn Patel.

On Wednesday, Patel temporarily ordered the popular music-trading service be shutdown at midnight Pacific Standard Time tonight. But the company appealed to the Ninth and argued that they would have to lay off employees and suffer considerable damage if forced to comply with Patel's order.

Luckily for the company and for millions of fans addicted to trading MP3s and other music files, the Ninth Circuit agreed with Napster. The service will continue operating as normal until at least September, when the company and record company executives make their arguments before the Ninth Circuit.

So trade freely, music lovers. Look out for those XIT MP3s.
