Ban on online cigarette sales struck down

A federal court in New York on Friday struck down that state's ban on Internet and mail-order sales of cigarettes.

The court said the ban interfered with Congress' right to regulate interstate commerce. The ruling strikes down a bill signed into law last year which was intended to prevent sales to minors.

But the bill had also been pushed through the state Legislature by Governor George Pataki after receiving complaints about sales of cigarettes on reservations and on Internet sites.

The state hasn't decided if it will appeal.
