Next steps in Ariz. gaming battle considered

THURSDAY, JULY 12, 2001

Now that a federal judge has decided Class III games in Arizona are illegal and that the current set of tribal-state compacts are unconstitutional, tribes are considering what steps to take next.

One avenue being considered is a voter initiative to legalize slot machines, blackjack and other Class III games at Indian casinos. This approach was taken in California, where tribes mounted a successful campaign to modify the state's constitution to authorize Vegas-style gaming on reservations.

Another is the legislative ratification model. Following the outcome of a similar lawsuit, the state of New Mexico has taken this route.

An appeal to the judge's decision is also under consideration.
