Ten New Mexico tribes and Attorney General Patricia Madrid last Friday asked the 10th Circuit Court of Appeals to clear the way for a $91 million casino settlement.

The tribes agreed to pay the state the money for payments owed under gaming compacts signed in 1997. Once the tribes pay, new compacts that have already been negotiated can be finalized.

Two tribes who have not agreed to pay are challenging whether the settlement can be approved by a federal judge.

But the longer the new compacts are delayed, the longer the tribes have to continue paying a 16 percent slot machine sharing rate. The new compacts cap the rate at 8 percent.
