Senate panel to consider three judges

The Senate Judiciary Committee will hold confirmation hearings for three of President Bush's judicial nominees next week, said Chairman Patrick Leahy (D-Vt.) on Thursday.

The three judges to be considered are Roger Gregory for the 4th Circuit Court of Appeals and Richard F. Cebull and Sam Haddon, both to the federal district court in Montana. Gregory has been given a "qualified" rating by the American Bar Association while Cebull and Haddon have been rated "well-qualified."

As an attorney for the state of Montana, Haddon sought to tax all cigarette sales in Indian Country, a case which made it all the way to Supreme Court. The Court struck down the state's attempt to tax sales to Indian customers but said non-Indian transactions could be taxed.

As a lawyer in private practice in Montana, Haddon later represented a non-Indian couple who tried to prove the Flathead Reservation had been terminated. He lost the case in the 9th Circuit Court of Appeals and the Supreme Court later declined to review it.

The hearing will take place next Wednesday.
