Government attorneys for the U.S. Nuclear Regulatory Commission filed their response to a suit filed by the state of Utah challenging the licensing of a nuclear waste storage facility on the Skull Valley Goshute Reservation.

The tribe has agreed to store up to 40,000 tons of waste on the 18,000-acre reservation. Nevada politicians and residents oppose the site and have been trying every way they can to stop it.

But until a license is actually issued, the Department of Justice says the state has no valid challenge. Government attorneys asked a federal judge to dismiss the state's lawsuit.

The NRC has released a final impact study saying the site would not pose harms to the environment. The Bureau of Indian Affairs had input into the finding.
